Facts:
Debtor filed for chapter 11 relief in 2010 and was converted to chapter 7. In May 2012, the chapter 7 Trustee issued a No Distribution Report and the case was closed. In November 2012, appellant Alexandria Consulting Group, LLC ("ACG") moved to reopen the case to purchase undisclosed assets that were in the possession of appellee Alexandria Surveys, LLC ("AS"). ACG was not a creditor of the debtor or otherwise involved with the debtor's case prior to its May 2012 closing. Over the objection of the debtor, the bankruptcy court granted ACG's motion to reopen and ordered an auction for the sale of the property in question. AS did not participate in the motion to reopen, but participated in the auction. ACG won the auction and AS appealed to the district court.
