The panel was divided however, as to the wisdom of the District Court's reasoning (which had reversed the discharge), that a showing of a "good faith effort to repay the loans" required a "commitment to future efforts to repay." Writing for the Court, Chief Judge Easterbrook concluded that the "good faith" obligation should not be so construed. Otherwise, there could never be a such a discharge because it is always possible that future prospects would improve and allow for payment.
