A global settlement involving transfers between estates and creditors was filed and a single creditor objected to the approval of the settlement on the basis that the record was inadequate and that the fact in the record were insufficient to support the approval of the settlement. In addition to the bankruptcy court approving the settlement, the settlement was contingent upon the approval of another bankruptcy court, the receivership court, the confirmation of a joint chapter 11 plan, and approval of a Court in Bermuda, all of which contingencies had been met. While the settlement had been substantially consummated, the court found that in any event overturning the settlement agreement would have been unwarranted on the grounds stated.
