Debtor owned a shopping center. The bankruptcy court disallowed Schwab's claim, finding that in no case was his alleged interest other than an equity interest. A 363 sale of the shopping center was held, and the court subsequently contemporaneously entered orders approving the sale and confirming a liquidating plan that provided for the distribution of the sale proceeds. The sale was free and clear under the terms of the Sale Order, and although Schwab had alleged an interest in the mall property itself, he failed to seek a stay within the requisite 14-day period.
